Lorian HOA Management Update
Dear Owners,
Summer is in full swing in Telluride! With an abundance of rain in June, we are enjoying a beautiful array of greenery and wildlife in our area. Below is an update on our most active matters.
Insurance Update
Our new Broker of Record, Marsh McLennan Agency (MMA), has been onsite and is preparing to market our property insurance renewal for October 2024. Two key factors potentially affect our sky-high premiums:
Classifying our structure as non-combustible (metal) frame versus the current wood frame classification.
Implementing fire risk mitigation measures as recommended by TMV and MMA. The Board is working to identify practical and effective measures to align with recommended fire risk reduction protocols that are coming to Mountain Village and our area. We will make reports available when our website is up and will solicit Owner input before any action is taken.
Roof Update
Phase 2-3 snow melt system defects and deficiencies have been fully identified. The corrective electrical engineering and Chromalox (snow melt) systems are being finalized per TMV regulations and warranty requirements. Once properly configured, we will receive final bids from two contractors. This work has turned out to be substantial and has been added to our damages claim with our previous roof contractor, LCI, and bonding company, Argonaut.
Legal Update
Depositions and case discovery have continued through July 2024. This is a very arduous process with so many parties involved, but an important step in preparing for mediation and trial. Our trial has been delayed until May 2025 per the San Miguel County Court. Due to the trial delay, our August 2024 mediation has been cancelled and will be rescheduled to early 2025. Although these delays are somewhat wearisome for us, it does allow for all our roof defects to be corrected, our damages claim to be revised and comprehensive expert reports to be prepared for trial. It is in the best interest of the Lorian to go into mediation and/or trial as fully prepared as possible for a productive outcome. In addition, these delays were out of our control. In April and May of this year, both Fireman’s Fund Insurance Company and Argonaut Insurance Company changed counsel. Because of that, the Court permitted these parties to reschedule certain deposition, causing months of delay. The trial is now set for two (2) weeks, May 12-23, 2025; we are confident this date is firm.
Improvements/Other Updates:
Sundeck-Catwalk repairs and improvements are underway. The waterproofing work on the top floor sundeck is nearly complete and the associated water damage has been repaired. There are concerns about the color and application of the finished sundeck product, and we are working with the contractor to explore options to improve the overall look. The work will soon shift to the second floor “catwalk” where the repairs will continue through the end of July and into August, 2024.
Our website is nearly complete. Telluride Consulting is doing final testing, and we hope to have it operational very soon.
Fiber will be available at the Lorian soon. Telluride Consulting will present two estimates (Mineral Belt Technologies & Ajalax) to the Board for review and approval. Clearnetworx will be bringing fiber to the property by the end of July or early August. Once the fiber has been run to the property, we can move forward with engaging a contractor to run the fiber to each individual unit.
The hot tub remains closed while the Board evaluates options and proposals for spa options. Identifying and repairing our existing in-ground spa will require significant demolition and will be very expensive. We are evaluation above-ground solutions that will be attractive and provide a spa our Owners and guests all enjoy.
We recently met with TMV regarding a pedestrian trail they are planning through the woods behind the Lorian. They intend to formalize and beautify an existing footpath to run from the lower San Joaquin stop sign up through the woods, along the east side of Prospect Creek, to the upper San Joaquin curve near Bear Creek Lodge. Our Lorian property crosses Prospect Creek on a very small triangle; therefore, the proposed path would cross about 16 feet of our property. TMV is requesting an easement through our woods. We will update Owners as this develops.
We have a new dining table for the pool patio area! We hope everyone continues to enjoy our outdoor pool area. Thanks to Rous, Dillon, Tony and the Telluride Consulting group for getting it and promptly setting it up the same day as delivery.
